High Court orders: Examine all legal aspects and take action regarding the Minority Department’s grant of Rs 5 lakh to the Madrasa

The School Education
Department has cancelled the recog-nition of Samara International Islamic School in Thanisandra, and the Madrasa running the school has been suspended. The state High Court has ordered a legal review of all aspects, including the return of the five lakh rupee grant given by the Minority Welfare Department.

A division bench headed by Chief Justice Vibhu Bhakru and Justice C.M. Joshi heard the petition and dismissed the petition filed by Samara Internation-al. The Minority Welfare Department has ordered the Principal Secretary to inves tigate and take action regarding the mon-ey given to a madrasa running an Islamic-school.

The division bench, which conducted the hearing, said that the court will not
give any opinion on the veracity of the al-legations of the petitioner in this case: Rs 5 lakh The bench said that all aspects, including the issue of withdrawal, should

be examined in accordance with the law and action should be taken without un-necessary delay. The amount of Rs 6 lakh given by the Minority Department to
the Madrasa should be returned. Samara International Islamic School in Thanisan-dra-is fake. The Department of School Education has revoked the school’s ac-creditation due to the forged documents.

This organization is not registered as a public trust. A three-member committee was formed on May 14 this year, after which the report was received and sub-mitted to the Commissioner of School Education on May 30. The association’s recognition was cancelled on the basis of violation of Section 39(f) of the Karna-taka Education Act, 1983. However, the Rs 5 lakh given to the organization has not been recovered. The petitioner, Ab-dul Hamid Pasha, a resident of Nayan-dahalli, Bengaluru, had requested that the authorities take action to recover the money.
